LEGAL & REGULATORY
Regulatory Representation Policy
Our role in the application process, and who owns the application.
We prepare and submit CQC and Ofsted applications on behalf of our clients. This policy explains exactly what that involves, what we may and may not do when dealing with a regulator, and the important fact that the application is yours, not ours. GoZtartUp is a trading name of Aice Limited (Company No. 14726496).
1. Our position, in seven statements
- GoZtartUp is a private consultancy. It is not a regulator, regulatory body, or government agency.
- GoZtartUp is not affiliated with, endorsed by, connected to, or recognised by the CQC, Ofsted, or any other regulatory body.
- GoZtartUp has no authority to approve, influence, expedite, or determine any regulatory decision.
- GoZtartUp prepares and submits regulatory applications on behalf of clients. The application is made in the client’s name, and the client is the applicant.
- All regulatory decisions, registration, approval, ratings, and enforcement, are made solely by the relevant regulator, based on its own independent assessment.
- GoZtartUp does not act as the Nominated Individual, Registered Manager, or any other statutory role within the client’s organisation.
- GoZtartUp’s involvement in the regulatory process ends when the application is submitted and the post-submission support period concludes. Ongoing regulatory compliance is the client’s responsibility.
2. You own your application
This is important, so we state it plainly. The regulator requires the applicant (you, as the proposed provider) to make the application. We prepare it and submit it on your behalf, but it is made in your name, and you own it. You review, verify, and approve the application content before it is submitted. The regulator assesses you, your organisation, and your application, not us.
3. What we do when dealing with the regulator
The following are within our service, and we may do them on your behalf:
- Prepare your registration application, based on the information you provide, for your review and approval before submission.
- Submit the application to the CQC or Ofsted in your name, with your authorisation.
- Respond to administrative queries from the regulator during assessment, based on information you have provided, with your approval of any substantive response.
- Provide supplementary documents and evidence to support the assessment, accurately and without embellishment.
- Prepare you for your interview or inspection, honestly, so you know what to expect and can perform well.
- Explain the regulator’s published requirements to you factually.
4. What we will never do
The following are things we will not do, because they would misrepresent our role or the facts:
- Claim to be a regulator, or claim any affiliation with or endorsement by one.
- Claim any ability to influence, expedite, or guarantee a regulatory decision.
- Contact a regulator in our own name as if we were the applicant.
- Fabricate, alter, or embellish evidence in an application.
- Coach you to give false or misleading answers to a regulator.
- Act as your Nominated Individual or Registered Manager.
- Use regulator logos or branding in a way that implies endorsement.
Honesty in the application process protects you. An application built on accurate information, and assessed on its merits, is the only kind worth submitting. If anyone suggests cutting corners with a regulator, that is not how we work, and it would put your registration at risk.
5. Interview and inspection preparation
We help you prepare for your interview or inspection so that you can represent yourself and your business well. This preparation is honest. We help you understand what the regulator is looking for and how to present your genuine knowledge and plans clearly. We do not, and will not, coach you to mislead.
